Welcome to PlayPick Games, a proprietary website and application of PlayPick Games Ltd. Thereafter referred to as PlayPick Games and vendors, members thereafter referred to as “user” in this document. These Terms of Use (the “Terms”) govern your use of the PlayPick Games (the “Company”) service available through our website located at https://playpickgames.com (the “Website”), and software applications, including the application entitled “PlayPick” and “PlayPick Vendor” (each, an “App” and collectively, “Apps”) the features, content, newsletters, communications, services, and resources available or enabled via the website and/or application (each a “service” and collectively, the “services”) that facilitates the scheduling and management of appointments booked with service providers on our platform (collectively, the functionality provided by the Website and App referred to as the “Service”). By clicking the “I accept” button, completing the registration process, browsing our Website, downloading and installing the App, or using the Service, you acknowledge that you have read and understood these Terms and agree to be bound by them. If not, do not download the Apps or use the Website or Service.

Services

This Platform allows users to book appointments for services from vendors near you based on geolocation. The platform contains a variety of service providers of various categories that you can choose to book an appointment with.

PlayPick Games is not affiliated with or in partnership with these vendors. We are only responsible for creating a platform where vendors are connected with the customers who need their services and are within proximity.

We operate the Platform and implement the tools and technical means to enable this relationship to work smoothly. PlayPick Games is not a part or subsidiary of any of the businesses listed on this platform.

We have no control over and do not guarantee the kind of service received or delivered. We do not guarantee the truth or accuracy of vendors' offers and the ability of vendors to produce a service as described.

We cannot give any undertaking that appointments booked through this Platform will be of satisfactory quality and, this and any other such warranties (whether express or implied) are disclaimed by us to the fullest extent permitted by law.

Membership and Registration

Membership is limited to persons who are eighteen (18) years and older, and who can form legally binding contracts under applicable law. You represent that you are at least 18 years old and that all registration information you submit is accurate and truthful. To create an account, you must provide a full name, email address, telephone number, and email address. A one-time verification code will be provided to the user upon signing up. And National Identification Number may be required for validation.

You are solely responsible for keeping your login details confidential and must not disclose or share them with anyone. You will be responsible for all activities and appointment bookings that take place using your login information. In the event of theft, loss, or unauthorized use of a user’s password or account, you must contact us immediately at hello@playpickgames.com.

Once you create an account, you will be able to select vendors of your choice and book an appointment, make payment, and use the inbuilt chat features.

Where we have reason to suspect or believe that there has or is likely to be a security breach or other misuse of our Platform, we reserve the right to require you to change your password. Failure to do so may result in us suspending or deleting your account.

Accessing our Platform and the Services

We do not guarantee that our Platforms or any of our services will always be available, uninterrupted, or fault-free. We will not be liable to any user of the Platform if for any reason the Platform is unavailable at any time or for any period.

We do not guarantee that our Platform or any content on it will be free from errors or omissions. You are responsible for making all arrangements necessary to have access to our Platforms and for ensuring that all persons who access the Platform through your user profile are aware of these terms of use and other applicable terms and conditions and that they comply with them.

Payment

You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. We partner with Paystack and other companies to manage payments; by using our Service you agree to provide Paystack with a valid debit/credit card (Visa, MasterCard, or any other issuer accepted by us) (“Payment Provider”) and also agree to Paystack’s Terms of Service. Your Payment Provider agreement governs your use of the designated debit/credit card, and you must refer to that agreement and not to the Terms to determine your rights and liabilities. By providing Paystack with your debit/credit card number and associated payment information, you agree that the Company is authorized to immediately invoice your Account for all fees and charges due and payable to the Company hereunder and that no additional notice or consent is required. You agree to immediately update your payment details in Paystack if there is any change of the debit/credit card used for payment hereunder. The Company reserves the right at any time to change its prices and billing methods, either immediately upon posting on the Company Properties or by email delivery to you.

The payment processor is solely responsible for all payment transactions consummated on our Platform.

Payments can be made through a debit card, bank transfers, or any other payment methods/channels our payment service partners may provide.

The sale prices of consultations, appointments, and services are displayed by each vendor. They are given in Naira.

The total price is stated in the offer at checkout and is due for payment when the order is placed.

By creating an account, you agree to be bound by these terms of payment.

Intellectual Property

We and our Partners own all intellectual property rights in the Platform and any materials published on it. These rights are protected under applicable copyright laws and all such rights are reserved. You may only access and use the materials for personal use and you may not otherwise reproduce, distribute, publicly display, or modify without a license to do so from us.

We own or are the licensor of all rights, titles, and interests, in and to the Platform including all rights under patents, copyrights, design rights, trade secrets, and any other proprietary rights. Any disassembling, decryption, extraction, re-use, re-engineer, reverse engineering, copying, or more generally any act of reproduction, representation, transmission, or use of any of these elements, in part or in whole, without the authorization of the company is strictly prohibited and may result in legal action.

User Content

You retain ownership of any content you submit or post on the Platform. By submitting content to the Platform, you grant PlayPick Games a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute such content for the purpose of operating and improving the Platform and its services.

You are solely responsible for the content you post and must ensure that it complies with all applicable laws and regulations. You may not post content that is defamatory, obscene, offensive, or otherwise inappropriate.

We reserve the right to remove or refuse to post any content that we believe violates these Terms or is otherwise objectionable.

Limitation of Liability

To the fullest extent permitted by law, PlayPick Games shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Platform, (ii) any unauthorized access to or use of our servers and/or any personal information stored therein, (iii) any interruption or cessation of transmission to or from the Platform, or (iv) any bugs, viruses, or the like that may be transmitted to or through the Platform.

In no event shall PlayPick Games’ total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Platform.

Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes. We encourage you to periodically review these Terms to stay informed of any updates.

Governing Law

These Terms and any disputes arising out of or related to them or the Platform will be governed by and construed in accordance with the laws of the jurisdiction in which PlayPick Games is incorporated, without regard to its conflict of law principles.
